MessageBoard - LegalTERMS OF USE
The short version
- MessageBoard is licensed to you through the App Store under Apple's standard licence terms, plus the few extras below.
- Quotes, jokes and facts are there to inspire and entertain - they can contain mistakes and aren't professional advice.
- Any purchase, payment or refund is handled by Apple.
- The laws of New South Wales, Australia apply, and your consumer rights are unaffected.
These terms apply to MessageBoard for iPhone, iPad, Mac and Apple Vision Pro, including its widgets ("the app"), made by Karan Fadnavis in Sydney, Australia ("I", "me"). By downloading or using the app, you agree to them. If you don't agree, please don't use the app.
01Your licence
The app is licensed, not sold, to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA; if the two conflict, the Standard EULA applies.
You may use the app for your own personal, non-commercial use on Apple devices you own or control, as the App Store's Usage Rules allow. You may not copy, modify, resell or redistribute the app, or reverse-engineer it except where the law allows.
02Purchases and refunds
The app is distributed by Apple through the App Store. Any price, payment and refund is handled by Apple under its own terms. To ask for a refund, use reportaproblem.apple.com.
03The content
MessageBoard shows short quotes, jokes, affirmations and facts for inspiration and entertainment. They're curated from a mix of sources: public-domain works, Wikipedia and Wikidata, well-known quotations, and original writing. A quote's attribution names its author; it doesn't mean the author endorses the app.
Content is provided in good faith but may contain errors, and some attributions are disputed. Translations are machine-generated and may not be perfect. On This Day entries describe real historical events, which sometimes include tragedies.
Nothing in the app is professional advice - medical, psychological, financial, legal or otherwise. Affirmations and mindfulness prompts are not a substitute for professional help.
Quotations remain the property of their authors or rights holders. If you believe something in the app infringes your rights, or you spot a mistake, email support@karanfadnavis.com and I'll review it promptly.
04Attributions
On This Day entries are adapted from Wikipedia and are available under the Creative Commons Attribution-ShareAlike 4.0 licence. Some facts draw on Wikidata, which is released under CC0. Public-domain texts come in part from Project Gutenberg.
The app includes Phosphor Icons and GRDB, both under the MIT License.
05Intellectual property
The app's design, code, split-flap board, name and icon belong to Karan Fadnavis. These terms don't give you any rights to them beyond using the app.
06Changes and availability
I may update, change or stop offering the app or any of its content at any time. I'll do my best to keep it working well, but I can't promise it will always be available or free of errors.
07Warranties and liability
To the fullest extent the law allows, the app is provided "as is" and "as available", and the Standard EULA's disclaimer of warranties and limitation of liability apply to it.
Nothing in these terms limits rights you have under consumer protection laws that can't be excluded, such as the Australian Consumer Law or the consumer laws of your country.
08Apple
These terms are between you and me, not Apple. Apple isn't responsible for the app or its content, or for providing maintenance and support. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it against you.
09Governing law
These terms are governed by the laws of New South Wales, Australia. If you're a consumer living elsewhere, you also keep the protection of the mandatory laws of your country.
10Changes to these terms
I may update these terms from time to time. The effective date above shows when they last changed, and continuing to use the app after a change means you accept the updated terms.
